By downloading or installing Dynetix Design Solutions software products, you agree to the following terms and conditions. If you do not agree with such terms and conditions please do not download or install the software.

Non-disclosure: you agree to keep all programs, data and documents which are related to Dynetix Design Solutions software products, which you obtain by using the products, in strict confidential. You agree not to disclose those programs, data and documents to any third party without the explicit consent of Dynetix Design Solutions

Non-competition: you certify that you are, and if you are acting on behalf of a third party that party is, not involved in any research, development, marketing or sales of HDL/ESL simulation and race logic analysis products. Furthermore, you will not allow any third party, who has not been authorized by Dynetix Design Solutions, to use Dynetix Design Solutions software products and User's Manuals that have been licensed to you.

Limited Use: the licenses granted to you are non-exclusive, non-transferable, and without the right to sub-license. You agree to install Dynetix Design Solutions software products only on the Authorized computer(s) and at the Authorized location(s). You agree not to use the licensed products and updates thereto for commercial gain such as incorporating Dynetix software into your own products or services without the prior approval of Dynetix Design Solutions. Furthermore, upon the expiration of the Dynetix Design Solutions product licenses, you agree to delete all Dynetix Design Solutions software products from you computer(s) and archives.

No Reverse Engineering: you agree not to reverse engineer any Dynetix Design Solutions software products, using such methods as merge, de-compile, disassemble or decode.  You agree not to use Dynetix Design Solutions software products in any way other than as expressively set forth in the products User’s Manuals.

No Obligation: Dynetix Design Solutions shall be under no obligation to correct any deficiencies in the licensed products, but intends to make reasonable efforts to do so. Furthermore, Dynetix Design Solutions shall not be obligated to provide supports to you resulting from misuse, damage, neglect, unauthorized modification, failure to maintain the correct operating environment or support contracts, or any other circumstances that are beyond the control of Dynetix Design Solutions.

DISCLAIMER OF WARRANTIES: YOU AGREE THAT DYNETIX DESIGN SOLUTIONS HAS MADE NO EXPRESS WARRANTIES TO YOU REGARDING THE SOFTWARE AND THAT THE SOFTWARE IS BEING PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND. DYNETIX DESIGN SOLUTIONS DISCLAIMS ALL WARRANTIES WITH REGARD TO THE SOFTWARE, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, MERCHANTABLE QUALITY, OR NO INFRINGEMENT OF THIRD-PARTY RIGHTS.

LIMIT OF LIABILITY: IN NO EVENT WILL DYNETIX DESIGN SOLUTIONS BE LIABLE TO YOU FOR ANY LOSS OF USE, INTERRUPTION OF BUSINESS, OR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS) REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT PRODUCT LIABILITY OR OTHERWISE, EVEN IF DYNETIX DESIGN SOLUTIONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
